Malaysia Employment Pass: Can Your Spouse and Children Join You?

Who qualifies for a Dependant Pass or Long-Term Social Visit Pass after Malaysia's June 2026 Employment Pass reform? Understand Category III exceptions, family documents and spouse work rights.

Your spouse and eligible children may be able to join you in Peninsular Malaysia when you hold a valid Employment Pass, but your exact EP category and its issuance date matter. The usual Dependant Pass is for a legal spouse and children under 18; an eligible adult child or parent normally follows a Long-Term Social Visit Pass (LTSVP) route instead. Neither family pass, by itself, authorises paid employment.

Before booking family flights or schools, ask HR for your EP category, original application/issue date, the family pass type for each person and who will submit their applications through the employer's ESD account. The June 2026 policy change makes a copy of an older colleague's approval especially unreliable.

Who can apply for which pass?

The current ESD Dependant Pass page names spouses and children under 18, while its LTSVP page covers adult children and parents/parents-in-law. The pages specify the company's registered ESD account as the application route; the foreign family member cannot simply turn up at a branch and demand a pass.

The 1 June 2026 Employment Pass change is crucial

Malaysia revised the monthly basic salary bands for new and renewal EP applications received from 1 June 2026. The official announcement shows Category I at RM20,000 or more, Category II at RM10,000–RM19,999, and Category III at RM5,000–RM9,999 under the general bands. These are EP salary thresholds, not independent family-pass fees or proof that a dependant is automatically approved. Manufacturing-related special cases and approval requirements can differ.

The important grandfathering rule: The Ministry of Home Affairs' revised policy FAQ, question 20, explicitly says Category III Employment Passes issued before 1 June 2026 remain under the old policy, which did not allow dependants. An old EP III holder cannot point at the new salary bands and assume the family right was retroactively added. Category III applications from 1 June 2026 are assessed under the new policy, but the actual family application still requires employer confirmation and Immigration approval.

Two employees, similar payslips, different outcomes:

  • Worker A: Category III EP was issued in May 2026 at RM4,000 basic salary and is still valid. Do not file a spouse's DP on the assumption that 1 June made it eligible. HR should examine the legacy restrictions and whether a future qualified renewal/change of status affects family options; no automatic conversion.
  • Worker B: A different employee is offered RM7,000 basic monthly salary with an EP Category III application made after 1 June 2026. The new category rules—not Worker A's old rules—apply, but RM7,000 does not alone prove the employer's EP or the family's DP will be approved. Ask HR for the current category approval, sector exception if relevant and separate DP eligibility.

Also distinguish basic salary from allowances: the FAQ says salary thresholds are based on basic pay, not housing/transport or the overall package. The older ESD EP overview still carries a generic above RM5,000 family note; treat the dated June reform and specific EP category as more precise for a 2026 decision, not a blanket family guarantee.

What your employer submits, and when

  1. Confirm the principal EP: HR checks that the EP is approved and valid, the employee's status/category/date allows the family route, and the Peninsular employer/sponsor is the one applying. The family pass cannot outlast the principal approval.
  2. Collect relationships and passports: Each family member needs a real passport, recent photograph, marriage/birth/adoption certificate as applicable, and any translations or embassy/consulate attestations/Certified True Copies (CTCs) required by the current ESD checklist. ESD downloads include DP and endorsement forms. Do not rely on an old untranslated certificate being accepted.
  3. Employer submits the right family application: Use the company's ESD online account, with a DP for qualifying spouse/minor child or an LTSVP for the appropriate adult/parent case. A family member's tourist entry does not itself create a long-term family pass.
  4. Follow the actual approval/visa and endorsement route: Depending on nationality and location, a Visa with Reference (VDR) may be relevant before entry. The MYXpats ePASS process covers DP and LTSVP, but a system approval letter and the issued/endorsed immigration pass are separate steps. Arrange flights after the responsible institution confirms the real required travel document.
  5. Check every person's end date: The dedicated DP and LTSVP services say family-pass validity depends on the principal's EP, and can be shorter when the family member's passport expires earlier. Do not book school or insurance assuming the maximum EP term belongs to every child.

Practical example: A worker has 18 months left on the EP, but the spouse's passport expires in nine months. The family's permitted duration may be capped by that earlier passport expiry. Renew the passport at the right stage and ask HR to determine whether the pending application must use the new or existing passport; do not assume an approved spouse pass can ignore passport validity.

Can your spouse work after arriving?

No, not on the Dependant Pass alone. The dedicated ESD service explicitly says applicants who want to work must apply for an Employment Pass. The ESD DP employment notice says the hiring company must apply through ESD and the worker must surrender or shorten the DP to take the EP because one person normally holds one pass at a time.

Example: Your spouse arrives with a DP and a Malaysian company offers a job starting Monday. A signed offer is not an employment permission. The hiring employer must establish EP eligibility and the correct sequence to shorten/end the DP, secure work authorisation and confirm the lawful starting date before any paid shifts. The same principle applies to someone holding an LTSVP.

A remote job is not an automatic exception. If a DP/LTSVP holder plans ongoing paid online work while physically in Malaysia, request an official determination from the relevant immigration/work authority rather than silently assuming foreign payroll makes it permitted. Do not hide the activity on an application.

What if the employer or family situation changes?

Principal EP is cancelled or a new company takes over: The family passes are tied to the principal's lawful status. Ask old and new sponsors about cancellation/shortening and new applications before employment changes, rather than assuming dependants remain unaffected. A child turns 18 while on a DP: ask the employer about switching to the appropriate adult family route in time; do not count on indefinite DP extension. An EP application is still pending: avoid relocating dependants as if the family approvals already exist.

A school or landlord wants a long contract: Compare the expected family-pass expiry with the school year and lease before paying large non-refundable sums. You relocate to Sarawak or Sabah: immigration is state-specific; use the East Malaysia entry and work guide rather than claiming the ESD Peninsular family permission transfers nationwide.

The decision to make with HR this week

Ask the employer to show your EP category, the date on which the underlying EP was issued/applied for, its actual end date, and the current family application category. Then assemble genuine relationship documents, choose DP for spouse/minor child or LTSVP for eligible adult child/parent, and get the company's submission and endorsement plan in writing.

If a spouse wants to earn income, start a separate Employment Pass discussion with the hiring employer before arranging their first working day. For general EP salary bands see Malaysia Employment Pass salary rules; for student-family arrangements see Malaysia Student Pass.
